Today, we had the opportunity to speak with Doctor Robert MacArthur, an orthopedic surgeon from California, regarding his encounters with wrong site surgery and intraoperative burns, along with the broader topic of "never events."

Who is Dr. MacArthur?

Doctor Robert MacArthur completed his undergraduate studies at the University of California, Berkeley, where he earned a double major in Biochemistry and Physiology. Throughout his tenure at the university, he distinguished himself not only academically but also as a prominent athlete, participating in both boxing and rugby.

Subsequently, Doctor Robert MacArthur pursued further education at Columbia College of Physicians and Surgeons, where he attained the position of president of the institution, which is now recognized as the Vagelos School of Medicine. Following this, Robert MacArthur proceeded to fulfill his orthopedic residency at Harbor UCLA. 

Dr. Robert MacArthur Addresses the Incidents

In terms of statistics, wrong site surgery typically occurs once in the career of an orthopedic surgeon, but for specialists in sports, hand, and spine surgeries, this occurrence rises to four times throughout their career. Unfortunately, many of these surgeons choose not to report or discuss such incidents openly. Dr. MacArthur holds a deep sense of pride in how he addressed these unfortunate events. Instead of attempting to conceal the incident, Dr. MacArthur responded differently. 

Dr. MacArthur’s Handling of the Wrong Site Surgery

Dr. Robert MacArthur conducted thorough investigations into the underlying causes of the two incidents he experienced and subsequently published several works detailing strategies to prevent similar occurrences. Over time, he became recognized as an expert in the field of preventable accidents, with two articles published in the leading orthopedic journal, The Journal of the American Academy of Orthopedic Surgeons. The first article provided a detailed account of the errors leading to the wrong site event, aimed at assisting other doctors in avoiding similar mistakes.

His second paper, co-authored with Dr. David Ring, Chairman of the AAOS, addressed the issue of the "shame and blame game" prevalent in such situations. Dr. MacArthur emphasized the rarity of taking responsibility for these incidents, as it is often easier to assign blame to others. He stressed that this approach not only discourages surgeons from reporting incidents but also hinders the crucial analysis of root causes necessary to prevent future occurrences. 

The Intraoperative Burn Incident with Dr. Robert MacArthur

When addressing the intraoperative burn incident, Dr. Robert MacArthur displayed the same thorough investigative approach he utilized in his research on wrong site events. For instance, he proactively contacted the manufacturer of the problematic clamp to inquire about similar burn incidents. The manufacturer revealed that the clamp had been "discontinued," leaving room for interpretation.

In order to mitigate uneven heating in large hinged clamps, Dr. MacArthur conducted a comprehensive investigation into the root causes of this issue. His investigation revealed that flash sterilization could contribute to uneven heating, despite nursing associations advising against its routine use except in emergencies. Further inquiry uncovered that St. Joseph's Hospital frequently utilized flash sterilization to accommodate consecutive surgeries without the need for additional equipment trays.

To prevent future burn incidents, Dr. MacArthur alerted St. Joseph's Hospital to the risks associated with both the specific clamp in question and the regular use of flash sterilization. Rather than attributing blame to the clamp, Dr. MacArthur took responsibility for the surgical error. Despite being informed that the clamp was hot, he handled it without discomfort, demonstrating his patience and commitment to proper surgical procedure. 

Shame and Blame, Dr. Robert MacArthur's Response

In discussing the issue of the "shame and blame game," Dr. MacArthur points out the tendency of both the legal and general public communities to confuse the "captain of the ship" concept with conducting thorough root cause analysis. According to this concept, surgeons are often held solely accountable for any adverse events experienced by their patients, such as wrong site surgeries. However, Dr. MacArthur stresses that this approach contradicts the principles of root cause analysis, which aim to understand deeply the factors leading to such events and to prevent their recurrence. Resorting to blame not only impedes proper root cause analysis but also discourages other surgeons from reporting similar incidents for fear of reprisals.

During the incident, Dr. MacArthur failed to notice that the large hinge of the clamp was significantly hotter, leading to a burn when applied to the patient's leg. Despite being proctored for case privileges at CHOC, neither the proctor nor Dr. MacArthur immediately realized the occurrence of the burn. It was only after dictating the operative report that a recovery room nurse pointed out a small red area on the patient's leg. Even then, Dr. MacArthur did not initially grasp the severity of the burn.

Dr. MacArthur cites the airline industry as a prime example of effective root cause analysis. Unlike in medicine, the aviation sector has consistently sought to comprehensively understand the underlying causes of adverse events rather than simply attributing blame to individual pilots. This dedication to understanding root causes has contributed to the industry's remarkable safety records.

However, Dr. MacArthur expresses regret that the medical community has struggled to fully embrace root cause analysis due to entrenched legal and public perceptions regarding the "captain of the ship" concept. As a result, preventable medical errors persist at alarming rates, unjustly tarnishing the careers and reputations of many healthcare professionals.

The incidence of wrong site surgery remains concerning, occurring at a rate of one event per surgeon per career, and up to four events per career for hand, spine, and sports subspecialists. 

Dr. Robert MacArthur “Sexual Harassment” Allegations

In 2023, it became apparent that individuals could level false accusations against others, tarnishing their names and reputations without facing any consequences themselves. Whether the accused individual is innocent or guilty, the mere accusation can inflict lasting harm on their professional standing.

Dr. Robert MacArthur recounted his decision to depart from a workers' compensation clinic due to suspected unethical behavior within the establishment. In apparent retaliation, the clinic manager allegedly conspired with a patient to fabricate a claim against him, alleging that he engaged in inappropriate behavior by purportedly "stripping naked in the middle of the clinic and soliciting sex in exchange for a favorable workers' comp report."

Notification of this accusation reached Dr. Robert MacArthur more than a year after he had left the clinic. Upon learning of the allegation, he insisted on undergoing a lie detector test to refute the claim. However, the accuser declined to participate in such testing.

Subsequently, Dr. Robert MacArthur discovered that both his lie detector test results and the accuser's refusal to participate would not be admissible in court. The attorney involved in mediating the situation warned him that the jury would likely be biased towards the accuser, potentially leading to catastrophic consequences if the case went to court. Despite the absurdity of the accusation, he was advised to settle the matter for $29,000. 

Conclusion

The Medical Board of California conducted an assessment of the accusations made against Dr. MacArthur and determined them to be lacking in credibility, suggesting an ongoing investigation into the clinic where the incidents allegedly occurred. When questioned about this matter, Dr. MacArthur implied that the clinic may have faced legal repercussions, although he refrained from confirming this.

Despite the aforementioned findings, Dr. MacArthur encountered difficulty in removing the accuser's claims from internet search results, resulting in the successful propagation of the slanderous campaign against him, despite his innocence. As a consequence, the defamatory allegations continue to be accessible to the public, even though they do not indicate any guilt on Dr. Robert MacArthur's part but merely serve as a recap of a complaint.

Dr. MacArthur strongly advocates for imposing penalties on individuals who make false accusations equivalent to the severity of the fabricated events. For instance, he believes that his accuser should be labeled as a sexual predator and convicted felon to accurately reflect the seriousness of their actions.

In conclusion, Dr. MacArthur contemplates the coexistence of both good and evil in the world, expressing a hope that those who encounter his story will never experience the devastating impact of baseless false accusations like those he has endured. Indeed, it's a sobering thought.

Dr. MacArthur is a distinguished orthopedic surgeon recognized for his proficiency in diagnosing, treating, preventing, and rehabilitating conditions and injuries affecting the musculoskeletal system. This encompasses a comprehensive understanding of bones, joints, ligaments, tendons, muscles, and nerves.

Diagnosis: Dr. MacArthur's exceptional diagnostic skills set him apart. Utilizing physical examinations, state-of-the-art imaging techniques, and laboratory analyses, he promptly and accurately identifies various musculoskeletal ailments.

Treatment:

Non-surgical Approaches: Dr. MacArthur advocates for exploring non-invasive treatments before resorting to surgery. His array of options includes medications, physical therapy, and other non-surgical interventions.
